These terms and conditions outline the rules and regulations for the use of Evalens's Website, located at evalens.app.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Evalens if you do not agree to take all of the terms and conditions stated on this page.

1. Definitions

• "Service" refers to the Evalens website and its functionalities.
• "We", "Us", "Our" refer to the owners and operators of Evalens.
• "You", "User" refer to the individual accessing or using the Service.
• "Content" refers to images uploaded by you and analysis results generated by the Service.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To upload or transmit viruses, Trojan horses, worms, or any other malicious code.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
• To infringe upon the intellectual property rights of others (e.g., uploading images you do not own or have permission to use).
• To upload inappropriate content including but not limited to: adult/sexual content, violent or disturbing imagery, illegal content, content that violates privacy rights of others, or content that promotes hatred or discrimination.
• To upload images of other people without their explicit consent, particularly in private settings.
• Otherwise attempt to interfere with the proper working of the Service.

4. Content Moderation

We reserve the right to:

• Monitor, review, and analyze uploaded content using automated systems including AI-powered content moderation.
• Remove content that violates these terms without prior notice.
• Suspend or terminate accounts that repeatedly violate our content policies.
• Report illegal content to relevant authorities as required by law.

You acknowledge that your uploaded content may be automatically analyzed for compliance with our content policies and applicable laws.

5. Your Content

You retain ownership of any intellectual property rights that you hold in the images you upload to the Service.

When you upload images, you grant us a limited, worldwide, non-exclusive, royalty-free license solely to host, store, reproduce, modify (e.g., create thumbnails and different sizes for performance optimization), process, analyze, and display the images and generated analysis results back to you through your account as part of providing the Service.

For immediate analysis features, this license includes temporary processing and storage of your images for up to 10 minutes to generate and deliver analysis results, after which temporary files are automatically deleted.

This license continues only for as long as your Content is stored on the Service (e.g., until you delete your account or specific images).

We may use aggregated, anonymized data derived from your uploaded content to improve our AI analysis services. This includes general patterns about photography styles, common technical issues, and overall service performance, but does not include your actual images or personally identifiable information.

We do not claim ownership of your images, nor do we share them with third parties or use them for purposes other than providing the Service directly to you.

You are solely responsible for the Content you upload and for ensuring you have the necessary rights to upload and use it with our Service.

6. AI Service Providers

Our AI analysis services are powered by third-party AI providers including but not limited to:

• Google Gemini (Google LLC)
• OpenAI ChatGPT (OpenAI Inc.)
• Mistral AI
• Other AI services as we may add from time to time

Your images are processed by these AI services solely to generate analysis results for you. These providers process your images according to their respective terms of service and privacy policies, but do not retain your images beyond the processing time required.

7. Service Availability and Modifications

We strive to keep the Service operational, but we do not guarantee that the Service will always be available, uninterrupted, or error-free. We may modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the account settings page.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the Service, or the information, content, or materials included therein.

The AI analysis provided is for informational and educational purposes only. While we strive for accuracy, we make no guarantees regarding the correctness, completeness, or applicability of the analysis results. You use the analysis at your own discretion and risk.

10. Limitation of Liability

In no event shall Evalens, nor its owners, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

For users located in the European Union, you also benefit from the protection of the mandatory provisions of the law of the country in which you are resident, and nothing in these terms affects your rights as a consumer under applicable EU consumer protection laws.

Any disputes arising from these terms or your use of the Service may be subject to the jurisdiction of Turkish courts, except where EU law provides for jurisdiction in your country of residence.

12. DMCA and Copyright

We respect intellectual property rights and expect our users to do the same. If you believe your copyrighted work has been uploaded without permission, please contact us at [email protected] with:

• Description of the copyrighted work claimed to be infringed
• Location of the allegedly infringing material on our Service
• Your contact information and a statement of good faith belief
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

We will promptly investigate and remove infringing content as required by applicable copyright laws.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
